Being in panel does not get vested right to appointment: HC | | | Early Times Report Jammu, Sept 22: A high court division bench of Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today said the candidates, even if they are included in the panel showing their provisional selection, do not get the vested right to appointment. The court directive came in a LPA filed against the judgment of writ court, seeking quashment of the select list or panel prepared by respondent No 4 with respect to two posts of Rehbar-e-Taleem for M S Degwar and GMS, Solla Jugal, advertised by respondent No 3 through notification dated July 19, 2012 and direction to the respondents to prepare a fresh merit list (panel) and include the name of the appellant in it, claiming that she was having a higher merit than the candidates included in the merit list. The case put up by the appellant was that the respondents issued advertisement on July 19, 2012, inviting applications from eligible candidates for engagement as Rehbar-e-Taleem teachers for various schools in different zones of district Poonch to fill up the regular vacancies of teachers in far-flung areas and in areas near the LoC under J&K Reservation Rules. As per the notification, the candidates from revenue village where the school was functioning alone could apply and in case of habitation predominantly inhabitated by SC/ST population, the candidates belonging to these categories only were to be considered for engagement. The minimum qualification prescribed was 10+2. With these observations, the bench upheld the order of single court. |
