Early Times Report

Jammu, May 6: Special Mobile Magistrate Passenger Tax Jammu OP Bhagat today rejected the bail application four Nigerians namely Frank, Greece, Ifiani and George who were arrested by the Gandhi Nagar Police from Mumbai.
The arrests were made on the basis of a complaint filed by one Naveen Anand who was lured to buy an SUV through an online site by depositing just Rs 5 lakh which the complainant paid to the accused through an account number given by the accused and after receiving the money they avoided the complainant. According to the report one Naveen Anand lodged a complaint in Police Station Gandhi Nagar that he was cheated online by one Donnie Alex who advertised for sale of imported SUV Land Rover on Quicker.com at a cost of Rs 5 lakh to be deposited in A/C No 34735925521 in advance. The amount was deposited by the complainant where-after Donnie Alex stopped picking up phone. Sensing some foul play, Naveen lodged a complaint with Police Station Gandhi Nagar. Special Mobile Magistrate Passenger Tax Jammu OP Bhagat after hearing Senior PO Vijay Sudan appearing for the State whereas Adv Monika Kohli appearing for the accused persons, observed that the investigation of the case is at its initial stage and in present case there is sufficient evidence on record which made the Court to believe that accused persons are prima-facie involved in the commission of offences and the law with regard to grant of bail is not static and each case is judged on its facts and circumstances but in the instance case accused persons are foreigners, probability of the accused persons absconding is very high and there is every apprehension that accused persons will jump over the bail and it will become difficult to procure their attendance during the investigation as well as trial of the case. With these observations Court rejected the bail application.
