Jammu, Feb 12: In a LPA filed by the State against the judgment of writ Court whereby Writ Court quashed the order of Compulsory retirement of Bumesh Sharma then Program Officer ICDS Project Samba with the observations that the order of compulsory retirement cannot be passed as shortcut to avoid the departmental inquiry, when such course is more desirable.
A Division Bench of State High Court Comprising Chief Justice Badar Durrez Ahmed and Justice Dhiraj Singh Thakur after hearing Advocate General Jahangir Iqbal Ganai, Advocate General with AAG Rohit Kapoor for the State whereas Sr. Adv Z A Shah with Adv Vipin Gandotra for the respondent, admitted the petition for hearing and fixed February 26, 2018 next date of hearing and ordered that in the meanwhile, there shall be stay of operation of the impugned judgment. |
