HC directs CEO to post petitioner within District HQ | | | Early Times Report Jammu, Apr 4: The High court of Jammu and Kashmir, Jammu wing today directed the Chief Education Officer Kishtwar Ajeet Kumar Sharma to post the petitioner whose detachment order was issued among over 200 teachers/masters working in attachment capacity at the District headquarter Kishtwar on security grounds. As per the details available with ET, the petitioner approached the High Court and challenged his single detachment order on security grounds from ZEO office Nagsini to Government Middle School Hullar on the direction of CEO Kishtwar. The counsel for the petitioner Advocate N.D. Qazi submitted before the Bench that the petitioner was attached in ZEO office Nagseni on security grounds upon the communication dated 26-02-2016 issued by the Sr. Superintendent of Police (HR) and Inspector General of Police CID (J&K) Jammu and stated that the detachment order of his client by the CEO Kishtwar was against the spirit of the justice delivery system wherein a single teacher was pointed out and detached within no time while at the same time the order issued by the Dy. CEO Kishtwar in response to the directions passed by the Secretary Education last week is yet to be implemented. It was further submitted by the learned counsel that the threat perceptions subsisted even till date and before passing the impugned order, it was obligatory on the part of the Chief Education Officer Kishtwar to obtain fresh reports from the concerned agencies. On the other hand Ravinder Gupta Additional Advocate General appearing on behalf of the State who was on caveat urged that the petitioner was attached in the Zonal Education officer Nagseni and the petitioner being a teacher was required to serve in the school and not in the administrative capacity. Justice Dhiraj Singh Thakur after hearing the arguments of the parties ordered that the respondents shall transfer the petitioner within the District Headquarter of District Kishtwar and in the meantime respondents including Commissioner Secretary Education, Director School Education Jammu, CEO Kishtwar Ajeet Kumar Sharma were directed to obtain the verification report from the Inspector General of Police to see as to whether petitioner in fact faces any threat perception based on the police report so as the competent authority shall pass appropriate orders. |
