Early Times Report Jammu, July 30: Railway Magistrate Jammu Yahaya Firdous convicted a stock broker in a cheque bounce case awarding him six months imprisonment and directed him to pay Rs 2.26 lacs to complainant. Railway Magistrate Jammu Yahaya Firdous after hearing Adv PS Parmar for the complainant Ravinder Prashad Gupta whereas Adv Vishal Mahajan for the Rakesh Pandoh Sub-Broker Globe Capital Market Ltd observed that court is satisfied that this technical plea taken by the accused is not sustainable, therefore, the court is convinced that the giving notice in writing and failure of the contrary to make the payment, is satisfied in this complaint. Since, the complainant has succeeded in bringing home all the ingredients of Section 138 of N.I. Act and the accused has miserably failed to prove his defence either by leading his evidence or from the evidence lead by the complainant, therefore, it is easy to hold that the accused is found guilty of the offence u/s 138 of N.I. Act who is accordingly convicted and awarded six months imprisonment and fine Rs 2 26, 000/- which shall be paid to the complainant as compensation. |
