Govt fails to submit pictures of land retrieved from encroachers, HC grants more time

Srinagar, Sept 13: The State High Court has granted government two weeks time to submit pictures regarding retrieval of state land claimed to have been retrieved by it from encroachers in each district of Kashmir division.
"We fail to see as to why the photographs and the site plan in terms of our orders regarding encroached land which has been retrieved in each districts has not been filed," said a division bench of Chief Justice Gita Mittal and Justice Dhiraj Singh Thakur while hearing a Public Interest Litigation.
The counsel for the respondents sought further time to comply with the directions made on August 14. "The respondents were merely asked to support their compliance with documentation. The compliance shall be filed positively within two weeks from today," the court said and posted the PIL on 22 October.
On August 14, the respondents filed compliance report under the signatures of Baseer Ahmad Khan Divisional Commissioner Kashmir, giving details of the encroachments which were claimed to have been removed pursuant to the order dated 23rd March 2018, passed by the Court. The court ordered then: "We additionally require the respondents to indicate on a site plan in an appropriate colouring the land which has been cleared of encroachments. Additionally, the respondents shall prepare the film as well as photographs of the land of which encroachments have been removed."
On the site plan the respondents, the court said, shall show in red colour the land which is still encroached and such area from which the encroachment have been removed in yellow colour.
