HC disposes of plea seeking Anantnag bypolls | | | Early Times Report Srinagar, Oct 16: Justice Tashi Rabstan of J&K High Court disposed of petition filed by one Ghulam Mohammad Wani of Pulwama seeking direction to authorities to hold the by-election for the Anantnag Parliamentary seat as early as possible, by providing that petitioner shall file a representation before Election Commission of India within ten days and project therein what has been pleaded by him in writ petition on hand. Wani, who was All J&K Kissan Mazdoor Party candidate for the Parliamentary elections for the seat, had challenged the inaction of the respondents wherein the respondents failed to conduct Parliamentary by-election to Anantnag constituency. More than year has passed since the vacancy was created. In the petition it has been submitted that a vacancy arose in the House of the People from 3-Anantnag Parliamentary (PC) of the State of Jammu and Kashmir with effect from 4th July 2016 due to resignation of a member of the House, namely, Mehbooba Mufti. By notification dated 17th March 2017 different dates were notified for various stages of election. However, by impugned order dated 1st May 2017, elections for aforesaid Constituency have been deferred due to prevailing law and order problem. Counsel for petitioner has stated that though elections qua 3-Anantnag Parliamentary Constituency have been deferred in terms of impugned order on the pretext of law and order problem, yet respondents are conducting Municipal Elections through length and breadth of the State and, therefore, respondents are required to conduct elections with respect to aforesaid Parliamentary Constituency as well. |
