ILLEGAL PAK-CLAIM OVER THE STATE OF JAMMU & KASHMIR

ous statement issued by Pak-Foreign office spokes person Taslim Askam on the J&K State issued in the media dated 7th July 2014 that the State was a disputed territory as harped on usually, which was out-brust over developing bleteral relations. That was her illogical, ambiguous statement. The Pak rulers of an aggressor country are free to justify their stand on deceptive and deceitful grounds, but merely terming a disputed territory on their own without any legal ground cannot chanqge its original status, which does not carry any weight. Pak never insisted to include disputed territory issue in the two nation agenda held in the past for so many times. It has been merely its misleading propaganda for vote bank at the cost of creating communal wedge. She should know that any claim, whatever may be, is staked by producing proofs on the basis of legal and historical basis but she has never justified her claim on solid grounds. On the basis of ground realities it appears that soon after State Accession to India, Pak forces and its patronized rally of tribal invaders by violating standstill agreement made with the Ruler of J&K State and unauthorized crossing international border and breach of trust, intruded in foreign territory by commuting en-masse killings of innocent people and breast beating bloodshed. Its gruesome violent aggression encroached upon 43rd State territory.
Keeping in view of their back ground of non-violence it was not possible for them to stop unending blood spilling which had being compiled by Pak forces knocked. The door of the UN Security Council for help them and submitted a representation that Pakistan had committed a horrific aggression over Indian State of Jammu & Kashmir and encroached upon 1/3rd of State territory, it asked to stop further bloodshed and to get the territory surrendered occupied illegally. After wards Pt. Nehru told to the nation that they had more military power than Pakistan but his conscience did not allow him to kill those with whom they and their fore fathers had been living together since centuries. Therefore UN Security Council was requested to help them into the matter.
The UN Security Council took it in its view and declared cease fire and asked to Pakistan to keep the status quo of the territory occupied by it during aggression till further orders. It, in its resolution further asked to Pakistan to vacate the territory occupied during aggression as well as it recognized also the J&K State sovereignty over India along with world powers.
In that chaotic situation of violence and holocaust of killings and bloodshed, and also killing of State forces, lamenting voice of his subjects requesting for lease of their lives, that event Ruler had no option except to accede his state to India and thus he acceded under Indian Independence Act of 1947. Thus the State and its subject were saved by the Indian forces, who after accession reached State to save the people.
Under the circumstances she should justify her sand on J&K State on legal grounds. So much so when the case was being for announcing his self-styled claim one after other over the State of being its next successor produced by Pak representative advocate Sir, Feroze Khan Noon in Security Council, he perplexly prayed to focus his attention to his last argument, that his country had claim over Kashmir which had based entirely on the argument that Kashmir was a Muslim majority territory and that under the partition agreement Muslim majority area if that was contiguous, should go to Pakistan automatically but his gross play of argument had too rejected flatly on the ground in replying that the Indian nationalism had never accepted two nation theory. Hence his case was dismissed. Further, having justified his majesty Government wish that the decisions announced related only to British India and that its policy towards Indian States continued in the cabinet mission memorandum of 12th May 1946, remained unchanged.
Thus Pakistan could not produce any proof to justify its stand over the J&K State. But despite the UN Security Council clarified in its resolution dated August 1948 and January 1949, announced that the responsibility for the Security of Kashmir rested with Government of India besides admitting the State sovereignty over India shall not be brought into question, and there shall be no recognition of the so called Azad Kashmir Government at any times as well as that grabbing territory of Kashmir by Pakistan shall not be consolidated.
In the light of that Pak failed to with draw its forces from the illegal occupied territory of J&K State. Apart from that, mis-adventure to cede Saksham valley out of Indian State status quo territory to China, where it had no sovereign rights as well as illegal immigration of aliens of Sunni sect to settle in northern areas for demographic change to harass indigoes people belonging to Shia sect besides other violations relating to alter status quo for the construction of Air fields and Basha Dam etc. It is answerable for these violations.
Pak spokes person Madam Taslim Aslam should know that Jammu & Kashmir State is not a disputed territory. It is absolute bilateral issue accepted internationally to remove any misunderstandings which was needed by them-India and Pakistan. The UN Security Council itself declared internationally that in the light Simla agreement, its Kashmir relating resolutions had no weight now. It had absolved all responsibilities of Kashmir case. On what ground she had pleaded Kashmir a disputed territory. Pakistan cannot use muscle power or use military force to bow India according to its terms and conditions just like Kalat State situated in Baluchistan. Whose ruler was treated with third degree treatment to accede his State to Pakistan and with that gruesome violence, he was compelled with pistol point to sign the accession document, resulting in revolt in his State which is still continue Pak ruling leaders headed by M A Jinnah had in mind that they would apply the same technique with the Ruler of J&K State, but he did not bow down according to the terms and conditions of Pak ruling leaders and acceded his State to India to save the boundaries and his subjects from the diabolic Pak army and its raiders. She may go to study J&K State history before its pleading to justify her stand to propagate the State disputed territory on Whimsical ground but its political status cannot be changed. Her Pakistan is an aggressor country branded already by the UN Security Council despite that her deception to twist the facts according to her interest cannot change the real position of the State.
It is a bickering raised by Pak ruling leaders to swallow the State. It, for that purpose tried to establish its claim by producing on un-authentic arguments, which were rejected by the UN Security council. Thereafter it started to use the violent policy to prick India. The terrorist were trained to sneak in the State for disruptive activates, killings and bloodshed, so much so the security forces are targeted and stones are pelted on them to save the terrorists. Pak rulers established its lobby in the valley of some criminal members by providing funds for holocaust, shutdown, strike, and bloodshed, which is a daily routine to paralyze the state administration.
The innocent youths are used by them as their shield to achieve its foal. It is very interesting that all the terror crimes and bloodshed committed by the valley based Pak stipendiary lobby at the behest of Pak rulers passed on India and its security forces to malign it internationally. It is followed the blood spilling technique after failure to prove his political right over the State. The National investigation Agency removed the mask from their faces and stripped at the cross road that they were Pak spies working for Pak cause in the State being Indian citizens in leave of receiving huge funds for creating, unrest, disharmony, killings and paralyze administration to achieve its goal to occupy the State by using gruesome violence and muscle power. This is the technique of Pakistan and its lobby, which needs reply in his same language.
