PIL seeking implementation of Pharmacy Act | DB grants time to file objections | | Early Times Report
JAMMU, Nov 27: In a Public Interest Litigation filed by All J&K Govt. Pharmacist Association seeking implementation of Pharmacy Act, 1948 in the state of J&K where the pharmacist profession is governed by J&K Pharmacy Act, 2011, whereas the Pharmacy Act, 1948 is uniformly implemented in the entire nation and the profession of pharmacy is also governed under the said Act uniformly which benefits the health of the common people, a Division Bench of State High court Comprising Justice Rajesh Bindal and Justice Tashi Rabstan granted time to Principal Secretary to file objection on or before February 11, 2018. In the PIL it has been submitted that in the late nineties when there was no state branch of the Pharmacy Council of India nor J&K had its own independent Pharmacy Council, courtesy Article 370 of the Indian constitution, the State unit of PCI could not be formed so far due to non-extension of the central Pharmacy Act of 1948 to the state of J&K, due to inaction and lackadaisical attitude of our local administrators. Therefore J&K state, instead of extending the jurisdiction of central Pharmacy Act 1948 to the state of J&K , chose to constitute its own Pharmacy Council under the auspices of its own J&K Pharmacy Act 2011. That the Composition of this council instead of being broad-based and all inclusive was narrowly confined to the Drug and Food Control Organization of J&K with some representation being given to the J&K Druggists and Chemists Association. |
