Prosecutirx turns hostile, leads to acquittal of 6 in rape case | | | Early Times Report Jammu, Feb 21: Principal Sessions Judge Reasi Kamlesh Pandita acquitted Mohd Iqbal, Bashir Ahmed, Mohd Rafiq, Nazir Ahmed, Mohd Sharif and Mohd Saleem who were facing trial in kidnapping and rape case, as prosecutirx turned hostile. While acquitting the accused, Court observed that prosecutrix and complainant are star witnesses and edifices for such cases. But in this both have demolished the prospect of the prosecution story. Other witnesses are formal witnesses but brother and sister of the prosecutrix have also toed to the line of prosecutrix and did not support the prosecution. The witnesses including the prosecutrix have also stood firm in their cross examination by the prosecution. Prosecutrix as well as other witnesses did not suggest involvement of accused in the alleged commission of rape and kidnapping. In this case prosecutrix is a married lady now who has voluntarily exculpated the accused persons. Therefore, in view of the given facts and circumstance of the case, the further trial of the case appears to be futile exercise and wastage of court time which can be utilized for some other substantial litigation. Therefore other witnesses who are formal witnesses and whose examination and non-examination will not cut any ice and also the end result of the challan. Therefore in view of the above stated facts, prosecution evidence is closed. Moreover, the prosecutrix is now married and also will get derailed in her matrimonial life when action will be taken against her for showing hostility towards the prosecution. |
