Court rejects bail of 2 brothers in minor's kidnapping | | | Early Times Report Jammu, May 1: A local court on Wednesday rejected the bail applications of two brothers who were arrested for allegedly kidnapping a minor girl. According to police, on 19.01.2019 a complaint was lodged with respect to kidnapping of a minor girl aged about 12-13 years. On this, FIR No. 64/2019 u/s 363 RPC was registered and investigation ensued. During the investigation police recorded statement of the victim u/s 164-A CrPC. Sub-Judge Jammu Pawan Kumar Sharma after hearing Sr. PO Puja Nijhon who opposed the bail observed that "it is painful to hear that victim in this case is only 12-13 years old and she has been subjected to physical assault as well as allegation of kidnapping is serious. It cannot be the ground for bail that accused are in custody for more than 10 days." The counsel for the accused, Mohammad Aslam and Sher Mohammad, sons of Mohammad Mansha, of Bye Pass, Sidhra, Jammu, claimed that due to civil dispute between the parties, a false case has been registered. The court observed that "no father would lodge a false case involving his minor daughter. Our society has not gone so low that such type of allegations could be thought by a father. Even the statement of victim recorded u/S 164-A CrPC is against the accused." |
