HC refuses to suspend lifer of woman, paramour | | | Early Times Report
Jammu, July 15: The J&K High Court on Monday rejected the application for suspension of life sentence of a woman who murdered her husband with the help of her paramour around seven years ago. A Division Bench of the High Court comprising Justice Dhiraj Singh Thakur and Justice Sanjay Kumar Gupta rejected the application filed by Abdul Rashid and others seeking suspension of the life sentence. According to the prosecution, on 21-03-2012, information received by the police station Mahore to the effect that a person namely Nazir Ahmed, of village Bathoi Danda Bass is lying dead near the house of one Haji Khushi Mohammad. He was being taken in suspicious circumstances for burial. In the investigation it was found that the deceased was suffering from tuberculosis for the last 14-15 years. For the last 7/8 years he was unable to walk and for the last 2/3 years he was confined to bed. In this period illicit relations between Nazir's wife and another accused, and with the passage of time the illicit relation got strengthened. They started visiting each other's houses and finding opportunities used to spend nights together. The court after hearing both the sides observed that the rationale of this practice can have no application where the court is in a position to dispose of the appeal for five or six years. In present case, this appeal is at threshold and it can be heard expeditiously; as held it was already fixed for final hearing but instead of arguing the main matter, counsel argued bail application only. There are no special circumstances made out for suspension of sentence and for grant of bail at this stage. "There are many appellants convicted in such like offence and are languishing in jails for more than five years of post conviction stage," the court observed. |
