Court reject bail in POCSO | | | Early Times Report Jammu, Aug 19: Principal Sessions Judge Reasi Kamlesh Pandita rejected the bail application of one Joginder Kumar who was allegedly involved in POCSO. According to the police case that applicant/accused is involved in case under FIR No.152/2019 for the commission of offences U/s 354/452 RPC read with 8 POCSO. Police report further reveals that on 31.07.2019 mother of the prosecutrix lodged a written complaint with the concerned police station with the aid of the Child Welfare Committee that on 19.07.2019 at about 9:00 a:m she had gone to collect wood from the forest and her husband was also out of home for labour work, the accused in their absence forcibly entered into the residence of the complainant where her minor daughter was sitting alone and the accused tried to abuse and outrage her modesty. On this, the case was registered in the concerned police station and the investigation was set in motion. Principal Sessions Judge Reasi Kamlesh Pandita after hearing both the sides observed that In this case, the charge-sheet has already been filed from which it appears that there are reasonable grounds for believing that the accusations against the accused person are prima facie true, therefore, accused does not deserve to be bailed out, moreover, the accused person has tried to outrage the modesty of a minor female victim who also happens to be his close relative. Moreover, the offence alleged to have been committed by the accused person is very much against the ethos of our culture and against the interest of the public at large. Any sexual assault upon a girl child is termed as most heinous and dastardly acts having social, psychological, physical and emotional repercussions on the life and prospects of a victim. The new legislation has been enacted with an object to deal with an iron fist on the offenders due to the ever increasing intensity of incidents of sexual violence against the children/minors. It is also duty upon the courts to fill the link with the objectives of the new legislation called POCSO, therefore, in the facts and circumstances of the case and in view of the above detailed reasons, the bail application filed by the accused person is outrightly rejected. —JNF |
