DB directs state to file status report on welfare authority for transgenders 8/30/2019 11:18:50 PM Early Times Report JAMMU, Aug 30: Hearing a Public Interest Litigation seeking rights to transgenders in J&K, a division bench of Chief Justice Gita Mittal and Justice Rashid Ali Dar, directed State to file a status report regarding possibility of creating a dedicated authority for the welfare of transgenders was directed to be placed before the Chief Secretary of the State for consideration and also directed to provide a copy of order dated 19th July, 2019 and today's order be sent to the office of the Chief Secretary to ensure compliance before the next date. DB observed that earlier, this DB while considering the status report dated 29th June 2019 has been filed by Feroz Ahmad Sheikh, learned Dy. AG. on behalf of the Social Welfare Department and other departments, observed that the report, however, is hopelessly deficient and only discloses instructions and communications inter se the departments. For instance, we are not informed as to the steps taken to ensure school and college admissions to the transgender community. DB further directed the State Government to place before this Court a status report which should set out not only directions and instructions, but the steps actually taken and the position on the ground with regard to ensuring and enabling an inclusive environment to the transgenders in the State. The status report in this regard shall be filed before the next date of hearing and it is pointed out by Moksha Kazmi, amicus curiae that in several other States, the State Governments have constituted Transgender Welfare Boards. There is no such Board or Authority in the State of J&K. Upon this DB directed Chief Secretary of the State examine this aspect of the matter and, if possible, designate/constitute a dedicated authority for the welfare of transgenders.
