Court rejects bail of accused in abetment to suicide case

JAMMU, Sept 7: CJM Samba Ajay Kumar Gupta rejected the bail application of one Kushal Kundal son of Lt. Sh. Kuldeep Raj of Rakh Chang Tehsil Ramgarh District, Samba who was booked by the Samba police in 306 RPC.
APP Anil Saini submitted that the offence committed by the accused is heinous and against the society and the sentiments of general public has been hurt because of the act of the accused as a young girl of 19 years old has lost her life. He has also submitted that from the statement of witnesses recorded during the investigation it has been prima facie established that the victim had committed suicide on the instigation and harassment of the accused. Thus accused should not be granted bail at this stage and the application should be rejected. If the accused is released on bail at this stage, it will affect the investigation which is at the initial stage. Moreover, if the bail is granted at this stage in such a heinous offence where a young girl had committed suicide because of the accused which fact is clear from the statements of witnesses, it win certainly shake the faith 6ffeeneral public at large on the criminal justice system.
CJM Samba Ajay Kumar Gupta after hearing both the sides observed that the accused is involved in a serious and heinous offence and the investigation are yet to be complete and prima facie involvement of the accused in the above mentioned case has been made out against the accused. Furthermore there is every apprehension that the accused will tamper the evidence. Thus, if in such type of offences the accused is granted bail, it will certainly affect the larger interest of public The general public will lose its faith in criminal justice system. Such type of accused is not entitled to the discretionary jurisdiction of the court for granting the bail. With these observations Court rejected the bail application. JNF
