Distress Sale Act 1997 fails to protect migrants property in Kashmir

jammu, Feb 9: Notwithstanding the enactment of Migrant Properties Act way back in 1997 to check the distress sale of migrant properties in Kashmir the same goes unabated in Valley.
According to sources in open violation of the Act the thousands kanals of migrants land has been sold in last over two decades with Government's failure to declare the same as null and void under law, though there is ample provision in the law in this regard.
Sources said the law has totally failed to protect the migrants left over property in Kashmir and respective District Development Committees also failed to act as the custodians of this property in different parts of Valley.
Sources said the DCs in Kashmir have failed to take action in such cases and the migrants property has been sold like hot cases in Kashmir.
Sources said the law only exists on papers while on the ground there is no action on the part of authorities while in various cases some of the migrants and those who had purchased their land have entered into a dispute after the later failed to pay the payments in full. Many such cases are pending in Revenue courts in Valley for years together, sources added.
Sources said in various cases the brokers who take a hefty sum as commission from the people intending to purchase the migrant land lure them with a good price leave a certain amount as advance payment take the possession of land and later fail to pay the remaining amount. There are many such cases for years together which have been in dispute, sources added.
Even in some cases the property owners and even the purchasers have died but disputes are there, sources said , adding the sucessuve Governments since then failed to maje the law more forceful and strong.
Sources said majority of displaced Pandits have sold their land in distress over the years with law failing to protect the same.
