Court rejects bail of habitual thief | | | Early Times Report JAMMU, July 24: Chief Judicial Magistrate (CJM) Jammu Amarjeet Singh Langeh today rejected a bail application of Mohd. Shafi, habitual thief who was arrested by the Bakshi Nagar Police Station. While rejecting bail application, CJM Jammu Amarjeet Singh Langeh after hearing APP Kuldeep Bhat for the Police observed that the investigation carried out thus far brings to fore that petitioner is involved in 5 FIRs and that Police Station Gool allegedly recovered 9 Scooties from petitioner out of which three are subject matter of theft in the FIRs registered with Police Station Bakshi Nagar, Jammu and two are subject matter of theft in FIRs registered with Police Station Pacca Danga, Jammu. Presently, it is stated that Petitioner is in custody of Police Station Pacca Danga, Jammu in connection with investigation of FIR pertaining to theft against him. Three FIRs registered with Police Station Bakshi Nagar, Jammu including one in hand are: 1. FIR no. 53/2021, 2. FIR No. 57/2021 and 3. FIR No. 86/2021. All the five FIRs registered against petitioner pertain to theft he allegedly committed from time to time. Matter does not end here. Investigation also reveals that Scooty allegedly stolen by petitioner in FIR No. 53/2021 was sold by him to one Jan Mohd. S/O Abdul Gani R/O Dalwas, Gool through a notarized instrument/deed. Similarly, Scooty seized in FIR No. 57/2021 also stands sold by petitioner to one Mohd. Shafi who is also resident of Dalwas. That a apart, investigation also points out that Police Station Katra has recovered 8 Scooties from another accused who too allegedly belongs to the gang of petitioner. This aspect, according to Investigating Officer however is subject to further investigation. Court further observed that bail if granted to him at this stage when investigation in different FIRs is going on against him - would only tantamount to get innocent public sucked into constant fear of threat to their lives and property at the hands of the likes of petitioner. Petitioner therefore, on facts - is not a soft stuff deserving concession of bail at this stage. Court further said that exploring options under other existing statute(s) against serial offenders by preparing their dossier would not only help State to send out a potentially strong message against flagrant violation of law with impunity by them but it would also instil a sense of security amongst public at large against lurking and insidious fear of broad day light thefts so chronically prevalent as on present in Jammu. —JNF |
