Court rejects bail plea of woman narcotic smuggler | | | EARLY TIMES REPORT
JAMMU, Aug 14: Additional Sessions Judge Kathua, Kamlesh Pandit today rejected the bail application of Ruby Rani, lady narcotic smuggler. The accused is involved in case under FIR No.85/2019 under section 8/15/NDPS Act as 2 quintal 20 kg of Bhuki (Poppy Straw) has been recovered from her on 5-5-2019 during raid from the concerned police after coming to know about her activities. The quantity recovered from the possession of accused/applicant herein is that of commercial quantity. Charge sheet stands already filed against the accused in this court and case is for evidence of prosecution as no witness has been examined by the prosecution till date. The said accused person is also involved in another case of same nature under FIR No.84/2019 under section 8/15/NDPS Act, for possessing 55 kgs of Bhuki which is also a commercial quantity. The accused is a repeat offender and the statutory bar under section 37 NDPS Act is attracted in this case. There is no such material on record which prima facie proves that she is not involved in the case rather there is ample evidence to prove contrary. Additional Sessions Judge Kathua while rejecting bail application observed that illegal trafficking and trade in Narcotic Drugs and Psychotropic substances has posed potential threat to the whole society as it is eating the very vitals of the society and the menace of traffickers is spreading its tentacles to every nook and corner of the U.T of Jammu & Kashmir which cannot be ignored when the recovery of contraband is immense . The accused /applicant herein appear to be a chronic and repeat offender therefore it is the responsibility of the courts to prevent the society when such facts are palpable. JNF |
