CJM pulls up PDD officials for failing to execute 13 years old decree | | | Early Times Report JAMMU, Oct 9: The Court of Chief Judicial Magistrate (CJM) Jammu, Amarjit Singh Langeh today took serious note of the lackluster approach of the Chief Engineer PDD in executing the decree which has been passed way back in 2008 having titled Kulwant Singh VS Chief Secretary and ors. The court directed the judgment debtor that is Chief Engineer PDD to remove the electric poles and transformer from the boundary walls of the decree holder, but despite the lapse of long 13 years predecessors Chief Engineers and incumbent CE PDD Jammu failed to execute the decree. When the matter came for hearing counsel for decree holder Mohammad Irfan drew the attention of the court towards the court previous court order dated 2-9-2021 whereby court issued a notice to Chief Engineer PDD as to why the Chief Engineer PDD Jammu not suffer a civil detention in conformity with the mandate of order 21 rule 32 CPC read with section 51 CPC for failing to obey and execute the decree in question. Counsel for the Chief Engineer filed the statements of facts and then CJM asked a specific query to a counsel what have you mentioned in your statements of facts, the counsel replied that we are not getting the land for shifting of the transformer and electric poles, to this CJM expressed its displeasure that for long 13 years you are taking same ground land is not available, this is decree passed by this court and it has to be executed. The CJM fixed the matter for compliance of the decree on next date of hearing October 22. |
