Court issues bailable warrant against Patwari Jammu Khas for non- appearance

Jammu, May 7: The learned Court of Principal District Judge Jammu today issued Bailable warrants to the tune of Rs 5000 against the Patwari Jammu khas for his non appearance before the court.
Taking serious note of Non appearance of the Patwari Jammu khas despite repeated issuance of the Summons by the Honble Court to produce the relevant record in respect of the suit property bearing khasra No 241 Mohinder Nagar, Canal road Jammu during the year 1985-1989.
As per the details available with Early Times, When the matter came up for the hearing today, Counsel for the petitioner Mohammad Irfan drew the attention of the court that despite repeated issuance of the summons by the court the patwari Jammu khas chosen not to appear before the Honble court.
He vociferously argued that even the summon has been recieved back with a endorsement that the Patwari Jammu khas had taken the snapshot of the summon which means that the Patwari well aware about the summons but he not appeared before the court as he has taken the summon of the court casually for which the Honble court has ample powers to ensure the presence of the Patwari in question whose appearance before the court is necessary to produce the relevant record of the suit property.
Counsel further contended that Patwari Jammu khas appeared once way back in the year 2020 in the month of January but the record which the Patwari brought was not relevant to the suit property. Counsel submitted that the Patwari brought Girdwari and Jamabandhi but after perusal of the record court directed the Patwari to produce the record of Mutation. Patwari in turn stated he brought the record of khasra no 207 but here in there is no mention of Mohinder Nath. Patwari then sought one month time to produce the record under the khasra no. 241.
Counsel for the petitioner vehemently contended that more than two years have elapsed but the Patwari Jammu khas did not appeared before the court.
After Considering the submissions of both the counsels, Honble Court of learned Principal District Jammu issued bailable warrants against the Patwari Jammu khas for his appearance.
Looking into the urgency of the matter as there is inordinate delay in proper adjudication of the matter, Honble court listed the matter for 21st of the May 2022.
