No one is above the law | | | The High Court of Jammu and Kashmir, Ladakh has dismissed the petition filed by Parvez Ahmad Nengroo seeking quashing of FIR registered by Anti-Corruption Bureau (ACB) in case of alleged 3000 illegal backdoor engagements in J&K Bank. The High Court while dismissing the petition filed by former J&K Bank chairman Parvez Ahmad Nengroo observed that it is not the case of the petitioner that all the illegal appointments have been made through a single order at one and the same time. As is clearly revealed from the material on record, these appointments were made from time to time over a period of about eight years by issuing a number of appointment orders in violation of the set norms. Thus, it is a case of distinct incidents having occurred which do not form part of the same transaction though the modus operandi for these illegal appointments may have been similar. The High Court has pointed out that these alleged backdoor appointments were taking place for eight long years. It means that the backdoor appointments had become a routine in the J&K Bank. The backdoor appointment scandal in J&K Bank came to fore in 2018 when the candidates who had qualified the exams for various posts in the Bank were dropped and the ones with the recommendations were selected. These candidates had approached the then J&K Governor, Satya Pal Malik, and had apprised him about the injustice that was done to them. Malik had intervened and ensured that the selected candidates were absorbed in the Bank. The investigations carried out by the various agencies had established that the backdoor appointments in J&K Bank were nothing new and this process has been going on for a long time. After J&K’s transition into a Union Territory, the J&K Bank has been revamped and every process is being monitored. The High Court by not quashing the FIR against the former J&K Chairman has driven home a point that no institution can be allowed to cross its limits and the ones who were a part of wrong doings cannot be spared. The message is loud and clear to all the institutions and their heads in J&K that they cannot take anything for granted and they have to follow all the norms. No one is above the law. |
