Court reject bail of husband in abetment to suicide case | | | Early Times Report JAMMU, July 4: City Judge Jammu Manjit Rai rejected the bail application of one Nand Kumar in abetment to suicide case. According to the police case that on 04.06.2022 an information received through telephone from PCR Jammu that one lady namely Sangeeta Bharti W/o Nand Kumar R/o Bade Rabeli, Chattishgarh, at present near Jaswant Plaza, Jammu who was admitted in GMC as burn case and died today. Her statement has already been recorded vide MLC no. 2961. She stated in her statement on 03.06.2022 that her marriage was solemnized ten years ago. She has given birth to 03 daughters and her husband made doubt on her. Due to that he always quarrels with her. Today at 02:30 PM, his husband started quarrelling with her and said that she is a characterless and started abusing her. Due to daily quarrelling and harassing of her husband, she put kerosene oil on her body and put in flames. While rejecting the bail application, City Judge Jammu Manjit Rai after hearing APP Arvind Rathore for the UT, observed that the accused is alleged to have committed the offence under section 306 IPC which is non-bailable and serious in nature, as such, the accused cannot claim bail as a matter of right. It cannot be overlooked the fact that this type of offence under 306 IPC is at great increase and causing alarm to the public at large. The offence is not against individual but is against society at large. The accused/applicant does not deserve any leniency in grant of bail. There is also apprehension that if the accused/applicant released on bail, he will try to win over the prosecution witnesses and tamper with the prosecution evidence. —JNF |
