| DB upholds detention of hard-core criminal under PSA | | | Early Times Report
Jammu, Aug 5: A Division Bench of Jammu & Kashmir High Court Comprising Justice Rajnesh Oswal and Justice Mohan Lal uphold the detention under PSA of Gaggu Din, alias Gaggu, a hard core criminal.
DB while dismissing the LPA filed by appellant had challenged the order of detention No. PSA/08 dated 10.08.2021 passed by the respondent No. 2 under the provisions of section 8(1) (a) of the Jammu and Kashmir Public Safety Act, 1978 (for short the Act) by way of a writ petition bearing WP(Crl) No. 53/2021 and the Single Judge vide judgment dated 17.12.2021 dismissed the said writ petition, observed that the order of detention is a precautionary measure. It is based on a reasonable prognosis of the future behaviour of a person based on his past conduct in the light of the surrounding circumstances.
With these observations, Division Bench uphold the judgment of writ court and dismissed the LPA |
