Crimes executed by children in conflict with law increased by almost 50% in Jammu and Kashmir in 2021 as compared with a year earlier, according to the latest National Crime Records Bureau (NCRB) report.
As defined under Section 2 (l3) of the Juvenile Justice (Care & Protection of Children) Act, 2015, “Child in Conflict with Law” is the one who is alleged or found to have committed an offence and has not completed eighteen years of age on the date of commission of such offence.
As per the NCRB data, at least 323 cognisable criminal cases involving juveniles in conflict with law were registered in 2021 as against 171 in 2020. The cases of crimes committed by the juveniles in 2019 were 299 but an apparent decrease in 2020 has a lot to do with the curbs on account of covid-19 pandemic.
Among the total cognizable offences registered in 2021, six pertained to murder, two of culpable homicide not amounting to murder, three cases of causing death by negligence, nine rape cases and one unnatural offence. The other cases include six cases under the Unlawful Activities (Prevention) Act, and nine under the Narcotic Drugs and Psychotropic Substances (NDPS) Act. Also among the total cases, 288 cognisable crimes were registered in 2021 under Indian Penal Code sections, the remaining 35 were under Special and Local Laws (SSL).
In all, according to the report, 408 juveniles were apprehended in 2021, while 433 cases involving juveniles were pending disposal.
Regarding the crimes against children, the NCRB report said 470 cases were registered in 2019, 606 in 2020 and 845 in 2021.
The data on both counts depicts need for correction as well as preventive measures. As regards crimes by the juveniles, the environment provided to them matters a lot. Here the role of parents and society is important. If they get into the wrong company or an unfriendly environment, they tend to be involved in crimes. Besides, some cases were reported, in India, wherein some criminals used juveniles to execute crimes like thefts and robberies. While keeping a continuous watch by parents is imperative, the government is expected to take all measures needed regarding correction measures. Counseling, modification therapy and psychiatric support, among others, prove very helpful. Regarding the crimes against juveniles, law enforcing agencies must get their act with swiftness and take all measures to ensure strict action against those who perpetuate crimes against the juveniles.
