Court reject bail plea of habitual theif | | | Early Times Report JAMMU, Sept 15: CJM Jammu Amarjeet Singh Langeh rejected the bail application of one Sunny Bali who was habitual thief involved in theft of vehicles. A complaint in writing was lodged by complainant in the case with respondent police station alleging therein that while he went to home for taking meals, some thief in the meanwhile barged into his shop and stole away three Titanic Batteries from his shop at Patoli Pul, Jammu. Based on this complaint, FIR no. 317/2022 for offences under sections 454/380 of IPC was registered and investigation started. During the course of investigation, petitioner was allegedly rounded up on 09.09.2022 and subsequently the subject matter of theft was also allegedly recovered. From investigation, it also emerges that petitioner is also involved in theft of three Scooties regarding which three FIR(s) bearing no.(1) FIR no. 68/2022, (2) FIR no. 69/2022 and (3) FIR no. 71/2022 all pertaining to theft stand registered against him in Police Station Mira Sahib. Investigation also suggests that the three Scooties have been recovered from petitioner in aforesaid FIR(s). Within in a span of 9/10 days, petitioner is alleged to have committed aforesaid theft of Scooties. And thereafter, on 07.09.2022, instant FIR for committing theft of Titanic Batteries valuing Rs. 1,20,000/-(rupees one lac twenty thousand) is allegedly committed by petitioner. CJM Jammu Amarjeet Singh Langeh after hearing APP Kuldeep Bhat for the UT, observed that no re-iteration that while considering bail application of a person who seems to be prima facie habitual offender, discretion to grant bail cannot be exercised in a whimsical manner and interest of society at large in such cases has also to be duly considered and taken note of (Vide (2007) 1 SCC 70). In the case in hand, all factors viz nature and gravity of offences involved and character of evidence in support of allegations - go poignantly against petitioner more particularly when investigation is at initial stage. For all what is said hereinabove, it is held that this application has no merit at this stage and the same is therefore dismissed. —JNF |
