Court awards 20 years RI, fine Rs 2 lakh to heroin smugglers

JAMMU, Oct 7: Principal Sessions Judge Jammu Sanjay Parihar today awarded 20 years rigorous imprisonment to Sanjeev Kumar from whom 10 KG Heroine was recovered.
According to the Police case that on 24.11.2017 a docket written at 11:45 AM was received at P/S Gandhi Nagar through Constable Narinder Singh on behalf of SI Madan Lal, I/C Police Naka that on 24.11.2017 at 11.15 AM he along with some police personals were performing Naka duty near Shamshan Ghat pulli Shastri Nagar NHW and during checking one vehicle of Model Endeavour bearing Registration No. PB10GB/6247 was coming from Gangyal NHW towards Shastri Nagar and on being stopped the driver disclosed himself as Sanjeev Kumar, S/o Brij Lal, R/o Miran Sahab Jammu. On frisking of the vehicle one black colour Bag was found in the dickey in which 09 packets of heroine like substance were lying wrapped in polythene for which accused could not give offer due explanation. The accused used the vehicle and heroine for the purpose of sale to youths of Shastri Nagar Jammu. Thus he committed offence U/S 8/21/22 NDPS Act. On receipt of the docket at P/S Gandhi Nagar Jammu, a case FIR No. 220/2017 dated 24.11.2017 was registered against the accused U/S 8/21/22 NDPS and the investigation was handed over to Mohammad Rafiq Manhas Dy.SP South/SDPO City Jammu who along with Magistrate 1st Class South Jammu went to the spot and sized the contraband. On further enquiry and on disclosure of accused the IO along with Ld. Magistrate went to house of accused at Indira Nagar, Miran Sahab and recovered 01 Kg of heroine as well as proceed of heroine amounting to Rs. 24,21,350/-.
Principal Sessions Judge Jammu Sanjay Parihar after hearing Public Prosecutor Kulbhushan Sharma for the UT whereas Adv Fahim Showkat Bhat for the accused observed that 4. The facts as proved in the present case are that the convict was in conscious possession of 10Kg of Heroin, being, in his vehicle Model Endeavour. The use of drug has become a major problem not only in our U.T but also in the Country. The younger generation may be, due to the exposure of latest electronic technology and other factors in fast paced life, has got a particular temptation towards the use of drug which is nothing but destruction of the youth and the mankind. The persons, who deal with the Narcotics, are not only a menace to the society but also to the entire social environment. Therefore, in order to effectively control and eradicate this proliferating and booming devastating menace, causing deleterious effects and deadly impact on the society as a whole, the sentence should be deterrent to the perpetrator of the crime which should serve a message to the persons involved in the narcotic trade. Court further observed that there can be no denial that in order to effectively control and eradicate this proliferation of Narcotic Drugs and its impact on the society, the sentence needed to be deterrent so that the person dealing with such acts would think twice before indulging in possession and transporting of illicit Narcotic Drugs. Though the convict is first time offender as there appears to be no past history of convict having indulged in such acts. But given the quantity so recovered, the maximum sentence as provided under law is required to imposed in this case so as to act as deterrent for other wrong doers. Consequently, convict Sanjeev Kumar is convicted under section 8/21 NDPS Act and sentenced to undergo rigorous imprisonment for a period of twenty (20) years and a fine of Rs.2,00,000/- (Two lac). In case of default of payment of fine, the convict shall undergo simple imprisonment for a period of one year. Copy of sentence along with copy of finding of guilty shall be provided to convict free of cost in the open court.
