Court awards life-imprisonment in attempt rape and murder case | | | Early Times Report
Jammu, Dec 6: Principal Sessions Judge Kathua Jaffer Hussain Beigh today awarded rigorous life-impriosnment for murder and four years imprisonment for attempt to rape to accused namely Sansar Singh. Police Station, Hiranagar has prosecuted the accused for commission of offences punishable under section 376 read with section 511 RPC for attempting to commit rape and under sections 302 RPC for committing murder of the deceased on 09.02.2017. Prosecution case in brief is that on 09.02.2017 at about 11.50 hours Police Station, Hiranagar, received an information through a reliable source that a lady having injuries on her head caused by a brick, has been thrown in the bushes at Kunthal and someone has attacked her due to enmity for committing her murder as a result of which the said lady is in pool of blood and is struggling for her life, etc. On receiving this information, FIR No.17/2017 for offence under section 307 RPC was registered and the investigation started. During the course of investigation, the Investigating Officer went on spot. The said lady due to those injuries died in Govt. Medical College Hospital, Jammu, so offences under section 302, 376, 511 RPC were added and offence under section 307 RPC was deleted. The dead body of the deceased Raj Kumari was taken in possession by the police. Seizure memo of the dead body was prepared. The dead body was identified by her sons Rakesh Kumar and Mukesh Kumar. Identification memo was prepared. Postmortem of the dead body of the deceased was conducted at District Hospital, Kathua. The dead body was handed over to her legal heirs for the last rites. The accused Sansar Singh was arrested on 10.02.2017. Principal Sessions Judge Kathua Jaffer Hussain Beigh after hearing Public Prosecutor Surinder Kumar for the UT whereas Adv KB Mahajan for the accused observed that The circumstance and the manner of committing the crime should be such that it pricks the judicial conscience of the Court to the extent that the only and inevitable conclusion should be awarding of death penalty which in my opinion does not arise in the instant case. For this reason, I find that the case does not fall within the category of rarest of rare case. Accordingly, sentence the accused Sansar Singh to undergo rigorous imprisonment for life and also to pay a fine of Rs.10,000/- for the commission of offence under section 302 RPC and in default of payment of fine he shall further undergo imprisonment of like nature for two years. As death penalty has not been imposed under section 302 RPC, for this reason, the accused is also sentenced to undergo rigorous imprisonment for four years and also to pay a fine of Rs.4000/- for the commission of offence under section 376 read with section 511 RPC and in default of payment of fine he shall further undergo imprisonment of like nature for six months. The sentences imposed upon the accused shall run concurrently. The accused be lodged in Central Jail Kote Bhalwal Jammu for undergoing the above said sentences imposed upon him. (JNF)
