Jammu & Kashmir High Court directs filing of affidavit on staff shortage issue | | | Early Times Report JAMMU, July 14: A Division Bench of the Jammu & Kashmir and Ladakh High Court, comprising Justice Tashi Rabstan and Justice Wasim Sadiq Nargal, has directed the filing of a better affidavit within two weeks regarding the dearth of staff at various levels, pay anomalies, and promotional avenues for law graduate readers of the High Court. The bench warned that failure to comply may result in coercive measures, including the stoppage of salary for those involved. During the hearing, the bench noted that a status report and government order had been submitted by the Special Secretary to the Government, Department of Law, Justice & Parliamentary Affairs, in response to a previous court order. The report indicated the creation of 24 posts for the personal staff of the judges of the High Court. However, there was no mention of compliance with previous court directions regarding the creation of 334 posts recommended by the High Court in 2015. The bench granted six weeks' time to file a fresh report and directed the Chief Secretary of the Union Territory of Jammu and Kashmir to take a final decision on the creation of the recommended posts. It also emphasized the need for clear timelines for achieving this target. The court expressed astonishment at the government's delay in implementing the High Court's proposal and failure to provide a satisfactory report on the steps taken by the Chief Secretary. It stressed the importance of adhering to court directives and warned of potential coercive measures if better compliance is not demonstrated. The court also instructed the Registrar General to initiate the process of filling the already created 24 posts and to submit a compliance report at the next hearing.
