High Court directs filing of criteria to assess "Low Vision" candidates | | | Early Times Report JAMMU, July 31: In response to a Public Interest Litigation (PIL) filed by the National Federation of Blind, Jammu Branch, a Division Bench of Jammu & Kashmir and Ladakh High Court, comprising Chief Justice N. Kotishwar Singh and Justice Wasim Sadiq Nargal, directed the concerned authorities to submit the criteria used to assess "low vision" candidates who have been selected and appointed under Section 34(1)(a) of the Rights of Persons with Disabilities Act, 2016. During the hearing of the PIL, the Division Bench considered the arguments presented by Senior Advocate SK Rongta, along with Advocate Ravi Abrol, representing the PIL, and Senior Additional Advocate General SS Nanda, appearing for the Union Territory (UT). The Bench observed that providing the merit list of candidates belonging to the "blind and low vision" category, as outlined under Section 34(1)(a) of the Act, along with the number of such candidates who have been selected for appointments, would assist in the proper adjudication of the matter. The PIL seeks clarity and transparency regarding the assessment process for "low vision" candidates who have been selected and appointed under the mentioned section of the Disabilities Act. The High Court's directive aims to ensure that the selection process is in compliance with the provisions of the Act and that deserving candidates are given appropriate opportunities and recognition. The Division Bench's decision comes as a step towards safeguarding the rights and interests of visually impaired individuals in the employment sector. The information sought by the Court will aid in establishing fair and equitable assessment criteria, fostering inclusivity and equal opportunities for all candidates, including those with low vision.
