Gross violation of reservation rules in Jammu and Kashmir

Jammu, Sept 9: In an open letter addressed to the Hon'ble Lieutenant Governor, Ch. Rashid Azam Inqlabi, Vice President of IGM, has highlighted a gross violation of reservation rules by the Jammu and Kashmir government in the recruitment of Assistant Professors in various medical colleges in the Union Territory.
The Jammu and Kashmir Public Service Commission issued notification No. 35–PSC(Dir-p) of 2023 dated August 3, 2023, inviting applications for 125 posts of Assistant Professors in medical colleges. While 51 posts were reserved for RBA (Reserved Backward Area) and 24 posts for SC (Scheduled Caste), there were no posts reserved for Scheduled Tribes (ST), Phari-speaking people, OSC (Other Social Castes), or candidates residing near the Actual Line of Control/Border area. This absence of reservation for these categories constitutes a clear violation of reservation rules.
Ch. Rashid Azam Inqlabi has appealed to the Hon'ble Lieutenant Governor to personally intervene in this matter. He expressed the hope that the Governor's administration would ensure justice for backward classes and people residing in far-flung areas. Instead of alleviating the suffering of these people, the administration has been disregarding the established legal procedures.
Furthermore, Ch. Inqlabi pointed out that the General Administration Department issued instructions (vide O.M No: GAD.. MTGORBIV/200/2021-09) on March 30, 2022, which also violated reservation rules. These instructions directed administrative secretaries of various departments to maintain a fresh reservation roster when referring posts to recruiting agencies, contradicting the provisions of the Reservation Act of 2005 and SRO 294 of 2005.
Ch. Rashid Azam Inqlabi emphasized that these instructions from the General Administration Department are not only contradictory to reservation rules but also against the spirit of the Indian Constitution.
