DB seeks status of wetlands declared Ramsar sites in J&K, Ladakh

JAMMU, Nov 22: A Division Bench of Jammu & Kashmir and Ladakh High Court Comprising Chief Justice N Kotishwar Singh and Justice MA Chowdhary granted a final opportunity to the Jammu and Kashmir government to file the report indicating the status of wetlands recognised to be of international importance and declared Ramsar Sites in J&K and Ladakh.
When the PIL came-up for hearing, DB observed that an affidavit containing the status report dated 09.11.2023 has been filed. A copy of the same shall be furnished to Amicus Curiae.
DB further observed that in spite of the order passed by this Court on 09.09.2022, the Union Territory of J&K has not yet filed a status report, while the Union Territory of Ladakh has filed the same. DB further observed that considering the importance attached to the issue and the desire of the Supreme Court to have the matter monitored by this Court, this Bench is of the view that failure to file a status report by the Union Territory of J&K is a serious lapse. However, grant a final opportunity to the Union Territory of Jammu and Kashmir to file the status report without fail. Failure to do so will result in appropriate penal action against those responsible for not filing the status report.
It is worthwhile to mention here that on 09.09.2022, DB observed that initially four wetlands of J&K and Ladakh were recognized as of international importance and were declared as Ramsar Sites under the Ramsar Convention on Wetlands.
During the course of hearing Amicus Curiae submits that recently three more wetlands of J&K and Ladakh have been added for the Ramsar Sites. Now following are the wetlands falling within the Ramsar sites. 1. Hokera Wetland, Kashmir, 2. Wular Lake, Kashmir, 3. Tso Moriri, Ladakh 4. Surinsar-Mansar Lakes, Jammu 5. Tso Kar, 6. Shalbugh, Kashmir, 7. Haigam, Kashmir
In order to focus first on the wetlands of the Ramsar Sites, DB require the Government of Union Territory to come clean with regard to their status and to file a complete report regarding all the above sites within six weeks.
