Early Times Report JAMMU, Jan 15: In a significant judgment, Additional Sessions Judge Jammu, Deepak Sethi, awarded life imprisonment to Gurbachan Singh, son of Jagga Ram, resident of Kotli Meerdian Tehsil R.S. Pura Jammu. The case, pending for the last 13 years, concluded with this decision. The case, registered under FIR No. 44/2010 on April 30, 2010, involved charges under sections 307/452/34/RPC. The complainant, Parsino Devi, wife of Darshan Lal, reported that her husband, who ran a cycle repair and barber shop at Rangpur Malana, was attacked by Gurbachan and Ravi Kumar. The accused, armed with weapons, assaulted Darshan Lal, leading to grievous injuries. During the investigation, it was revealed that Gurbachan Singh harbored animosity towards Darshan Lal due to false allegations about his wife having an illicit relationship with Darshan Lal. Despite efforts to reconcile them through panchayats, the accused maintained enmity and, on April 30, 2011, entered Darshan Lal's shop armed with weapons and assaulted him, causing fatal injuries. After considering the circumstances, Additional Sessions Judge Deepak Sethi opined that life imprisonment is an adequate punishment, as the case does not fall under the rarest of rare category. The court ordered that Gurbachan Singh undergo simple imprisonment for life for the offense under section 302 RPC and an additional 10 years for the offense under section 449 RPC, with both sentences running concurrently. The confirmation of the conviction and sentence is subject to the High Court's review. |
