NDPS Act Case: Court rejects bail plea of accused | | | Early Times Report SAMBA, Jan 15: Zubair Ahmed, son of Ab. Hamid Bhat, residing in Numblan Sheeri Narwa, had his bail application rejected by Additional Sessions Judge Samba, Adnan Syeed. Zubair Ahmed was facing trial under the NDPS Act. The prosecution strongly opposed the bail application, citing the involvement of the accused in an offense under the NDPS Act with a commercial quantity of 4000 bottles of COREX recovered from him. The prosecution argued that, in accordance with section 37 of the NDPS Act, the bail application is not maintainable and deserves outright rejection. The accused was arrested in a case registered at Police Station Samba under FIR No. 154/2019 U/S 8/21/22/29 NDPS Act. The prosecution emphasized the seriousness of the offense, the potential for a 20-year sentence, and the accused's role in drug smuggling. Additional Sessions Judge Adnan Syeed rejected the bail application, noting that the recovery of 4000 bottles of COREX from the accused falls under commercial quantity, triggering the bar created under section 37. The NDPS Act has stringent provisions for controlling and regulating operations related to narcotic drugs and psychotropic substances. The court emphasized that offenses related to narcotics have a more profound impact on society compared to culpable homicide. Granting bail at this stage could have deleterious effects on society, encouraging offenders and spreading a wrong message. The court concluded that bail cannot be granted without ensuring that the accused has not committed the offense and is not likely to repeat it while on bail. |
