Prof Hari Om writes book on SC's landmark judgment | Abrogation of Article 370' | | Early Times Report JAMMU, Feb 29: Former Head of the Department of History Department of Jammu University, Professor Hari Om, has written a book "Abrogation of Article 370" on the Supreme Court's landmark judgment. The book deals with the circumstances leading to the reading down of Article 370, abrogation of Article 35A and reorganisation of Jammu and Kashmir State on August 5-6, 2019. The book is based on what actually happened in the Parliament on August 5-6, 2019, and what transpired in the Supreme Court of India between August 2 and September 5, 2023. It is virtually an eyewitness account and written in a particular style. It also throws light on the nature of arguments put forth by the protagonists of separate status for Jammu and Kashmir- based on purely religious considerations and flawed federal concept and flawed concepts of internal sovereignty, secularism and democracy and the counter arguments as put forth by the Narendra Modi Government in the Supreme Court to defend the reform scheme. Besides the nature of arguments advanced by the rabidly anti-integration and intensely pro- integration senior counsels, the book also throws light on the very significant observations Chief Justice of India Dhananjaya Y Chandrachud and other judges of the five-judge constitutional bench made and the pertinent questions they put to both sides - petitioners and respondents. The book, in addition, deals with the nature of the Supreme Court's judgement and its long-term impact on the country's polity and the process of national integration. The results would have been disastrous, had the Apex Court given judgement against the 2019 reforms. The book also throws light on this aspect. Professor Hari Om while commenting on his new book said, " I had been writing and speaking against Article 370 and Article 35A and vouching for reorganisation of Jammu and Kashmir State on a regional basis since March 2, 1990. On August 4, 2019, I addressed press persons and urged the Prime Minister Narendra Modi and Home Minister Amit Shah to do what I suggested on August 4." He said, " My refrain all along had been that abrogation of Articles 370 and 35A and reorganisation of the state alone could break the backbone of jihad in Kashmir, limit the area of strife to the tiny Kashmir Valley, and help the under-threat, discriminated against, humiliated, marginalised and grossly ignored people of Jammu and Ladakh regenerate their socio-cultural and politico-economic life. Such a reorganisation would strengthen the nationalistic constituency in the highly strategic region and help the authorities in New Delhi tackle the menaces of separatism, terrorism and communalism in Kashmir in an effective manner was my other point of view." Professor Hari Om further said, "It was a very pleasant and thrilling co-incidence that the Narendra Modi Government read down the separatist Article 370, abrogated illegal and discriminatory Article 35A and reorganised the state by creating two Union Territories-the Union Territory of Jammu and Kashmir and Union Territory of Ladakh-out of it on August 5, 2019, the day the contents of my press conference appeared in a number of dailies. Not one person in the state, nay anywhere in Bharat, had ever imagined that the nation would witness a reform scheme of such a great national import. But Narendra Modi and Amit Shah did it, and in a very effective and convincing manner, to change the course of political history of the state and the country." |
