Early Times Report JAMMU, Mar 14: The ongoing dispute between the National Sports Federation, represented by the Fencing Association of India (FAI), and the J&K Amateur Fencing Association has reached a new chapter as the latter has lodged a Miscellaneous Appeal (MA No. 07/2024) challenging the Order issued on January 15, 2024, by the 1st Additional District Judge, Jammu. The trial court's decision, which dismissed the interim injunction application and allowed the Adhoc Committee to proceed with fencing activities in the Union Territory of J&K, was met with resistance from the J&K Amateur Fencing Association. The appeal filed by the association contests this decision and seeks redressal from the Jammu Wing of the High Court of J&K and Ladakh. In the recent proceedings before Justice Sanjeev Kumar, Senior Advocate Gagan Basotra, supported by Advocate Sachin Gupta, argued fervently for a stay on the trial court's order. However, Advocates Supriya Chouhan and Hemant Phalpher, representing the FAI and the Adhoc Committee, respectively, strongly opposed the plea for a stay order. Despite the arguments presented, the High Court opted not to grant a stay on the operation of the trial court's order. Instead, it issued notices to all contesting parties, with Advocate Supriya Chouhan accepting notices on behalf of the Fencing Association of India (FAI) and the Adhoc Committee. Additionally, notice was issued to Advocate Anshuja Tak, representing the J&K Sports Council. Moreover, the High Court directed the Registry to procure the scanned records from the lower court and listed the matter for further hearing on April 3, 2024. This decision indicates the court's intent to thoroughly examine the case before making any rulings on the appeal.
