HC invalidates selection process for Assistant Professor Sociology post under EWS category | | | Early Times Report JAMMU, May 6: In a recent judgment, Justice Sanjeev Kumar of the Jammu & Kashmir and Ladakh High Court invalidated the selection process conducted for the post of Assistant Professor Sociology under the Economically Weaker Section (EWS) category. The court observed that there was no evidence suggesting that the University of Jammu had made provisions for EWS reservation in its statutes or regulations. The case stemmed from a petition filed by an individual who applied for the Assistant Professor Sociology position under the EWS category. Despite being provisionally selected, the petitioner challenged the selection process, citing the lack of legal framework for EWS reservation in the university's statutes or UGC guidelines. Justice Sanjeev Kumar scrutinized the UGC guidelines and government notifications related to EWS reservation but found no mandate for such reservation in state universities like the University of Jammu. Noting the absence of a legal basis for EWS reservation in the university's statutes or UGC guidelines, the court ruled that the advertisement notification and subsequent selection process under the EWS category were without jurisdiction and authority. As a result, the court quashed the advertisement notification and directed the university to issue a fresh notification for the Assistant Professor Sociology post in accordance with the law. The university was also advised to consider providing EWS reservation, subject to statutory provisions and UGC guidelines. This decision underscores the importance of adherence to legal frameworks and guidelines in recruitment processes, ensuring transparency and fairness in the selection of candidates for academic positions. |
