JAMMU, May 8: In a resolute stance against delays in compliance with judicial orders, the Central Administrative Tribunal (CAT) Jammu, presided over by Members Parshant Kumar and MA Latifi, issued a stern warning emphasizing the non-negotiable nature of judicial directives.
The tribunal's attention was drawn to a contempt petition stemming from a judgment dated 08.05.2023, wherein the Division Bench had directed the release of pension and pensionary benefits to a retired employee within three months. Despite repeated orders, the respondents had failed to fulfill their obligations, necessitating the contempt petition.
CAT's observation underscored the fundamental right of every employee to receive their pension, which is enshrined as a constitutional right. The tribunal emphasized the gravity of the situation, particularly for a pensioner who had dedicated years of service and was now grappling with financial uncertainty due to the delay in receiving pensionary benefits.
Despite assurances from the respondents regarding the active consideration of the petitioner's case, CAT reiterated the imperative of timely compliance with judicial orders. The tribunal made it unequivocally clear that failure to adhere to the judgment within the stipulated timeframe would result in coercive action, including the personal appearance of concerned officials before the court.
The tribunal emphasized that justice delayed is justice denied, and any administrative wrangle should not impede the implementation of court orders. CAT's unwavering stance serves as a stark reminder that judicial directives must be respected and followed without delay or lethargy.
The tribunal's firm resolve underscores the principle that nobody is above the law, and judicial orders cannot be circumvented. The insistence on personal appearance underscores the seriousness with which CAT regards the matter, ensuring accountability and upholding the sanctity of the judiciary.
