HC directs CB shall not use any coercive measures for realization of property tax to tune of more than Rs 12 crores for AAI | | | Early Times Report JAMMU, July 1: The Jammu & Kashmir and Ladakh High Court directed Cantonment Board not use any coercive measures for realization of the property tax to the tune of Rs. 12,81,69,357.00 from Airport Authority of India. This significant order has been passed in a petition filed by Airport Authority of India through Advocates Inderjeet Gupta with Adv Yatin Mahajan. Justice Mohd Yousaf Wani after hearing Advocate Inderjeet Gupta with Advocate Yatin Mahajan issued notice to the respondents. Advocate Sumant Sudan, Advocate appearing vice Mr. Vishal Sharma, DSGI accepts notice on behalf of the respondents. Respondents shall file objections by or on the next date of hearing. Court heard Adv Inderjeet Gupta with Adv Yatin Mahajan for the petitioner in respect of his prayer for grant of interim relief and considered his submissions. Perused the interim application supported by an affidavit and also perused the main petition and the copies of the documents enclosed with the same. Court order for listing of petition on August 5, 2024 and in the meantime, subject to any vacation/modification upon the consideration of objections/arguments and till next date of hearing, the respondents are directed to revisit the orders dated 08.09.2023 and 07.06.2024 in the light of the averments made in the writ petition and are also directed to submit a consideration report by or on the next date of hearing, by which date, they shall not use any coercive measures for realization of the subject tax. —JNF |
