| DB upholds detention narco smuggler | | | Early Times Report
JAMMU, July 24: A Division Bench of Jammu & Kashmir and Ladakh High Court Comprising Chief Justice (A) Tashi Rabstan and Justice Rajnesh Oswal dismissed the petition filed by Anil Singh who was detained under PITNDPS.
While dismissing the petition and upholding detention, DB after hearing Adv GS Thakur for the appellant whereas AAG Amit Gupta for the UT, observed that Merely mentioning of wrong statute in the order for executing the order of detention passed by the Detaining Authority would not vitiate the order of detention passed by the Detaining Authority, which is otherwise found to be in accordance with law.
DB examined the judgment passed by the writ court and do not find any reason so as to warrant interference at our end. The Single Judge has considered and dealt with all the contentions raised by the appellant in accordance with law, DB Said and dismissed the appeal as there is not merit in the appeal.
