Court awards 3 years imprisonment to Matador driver for rashly, negligently diving causing death of 16

JAMMU, July 24: Sub-Judge Ramnagar Raj Kumar Lalhal awarded 3 years imprisonment to Ravi Shanker S/O Gulaboo Ram R/O Village Kirmoo Tehsil Ramnagar District Udhampur a matador driver for negligently driving the matador which caused 16 innocent persons lost their lives and 17 other persons injured.
While awarding sentence, Sub-Judge Ramnagar Raj Kumar Lalhal observed that Before writing Judgment I would like to quote some famous quotations in dispensation of criminal justice system as under:-

The prosecution case in a narrow compass is that on 20-10-2015 police station Ramnagar received information from reliable sources that a matador bearing registration no. JK14C-8068 being driven by unknown driver from Ghordi towards Ramnagar carrying passengers. Driver was driving the vehicle rashly, negligently and recklessnessly and at 8 AM when reached at Kanah nearby Mata Kali Temple did not control the vehicle and caused accident. Vehicle fell into deep gorge near about 150 feet, some passengers died on spot and some passengers got grievously injured who are taken to Ramnagar hospital.
Sub-Judge Ramnagar Raj Kumar Lalhal after hearing APP Yuvraj Singh for the UT whereas Adv SK Gupta for the accused persons observed that in the light of evidence on record and after hearing to both sides I am of the considered opinion that prosecution has proved that on fateful day i.e. 20-10-2015 the offending vehicle bearing registration no. JK14C-8068 was being driven by the accused rashly, negligently and dangerously ultimately which caused accident which was also over loaded against sitting capacity as a result of which 16 persons died and 17 persons got injured beyond reasonable doubt. The accused is identified by all the star witnesses. As such concluded that prosecution has successfully proved the guilt of the accused for the charges leveled against him punishable u/s u/s 279/337/338/304-A RPC, 66/192, 24/25/184 M. V Act beyond reasonable doubt. Thus challan is accepted and accused is convicted for the commission of an offence punishable u/s 279/337/338/304-A RPC, 66/192, 24/25/184 M. V Act. 92 and observed that the accused for the charges leveled against him punishable u/s 279/337/338/304-A RPC, 66/192, 24/25/184 M.V Act accused is convicted for the above said offences and awarded 3 years imprisonment.
