Court awards 7 years imprisonment in culpable homicide

JAMMU, July 26: Additional Sessions Judge Jammu Deepak Sethi today awarded seven years 11 months imprisonment Vijay Singh alias Bittu facing trial in 304-II RPC.
Brief facts of the case of the Prosecution are that on 24.10.2003 the complainant namely Aushutosh Singh had moved a written compliant in Urdu before the SHO Police Station Jhajjar Kotli, Jammu in which it was submitted that he was resident of Jindrah, the deceased Nanak Singh S/o Amar Singh Caste Rajput R/o Sahano is his uncle. In the morning at about 07:00 Am, Vijay Singh alias Bittu S/o Kesari Singh R/o Sahano along with Kala S/o Not known name not known R/o Shama Chak were ploughing the field in front of the gate of the Nanak Singh. The dispute was already going on between the parties with respect to the land in which the accused were ploughing the land and in furtherance of common intention and in order to kill the deceased both the accused persons while carrying arms in their hands starting beating the deceased. The accused Vijay Singh alias Bittu had beaten the deceased with the back side of the
Darat and accused Kala also inflicted injury with stick to the deceased and due to the said beating, the deceased had died on the spot. The body of the deceased was lying on the spot. On the basis of this information, FIR bearing no. 123/03 was registered.
Additional Sessions Judge Jammu Deepak Sethi after hearing both the sides observed that So while convicting the accused Vijay Singh under Section 304 part II RPC I sentence him to undergo a imprisonment for the period already undergone by him as under-trial prisoner which is more than 7 years, 11 months and 07 days.
