CJM rejects bail of PDD employee who fired on Advocate | | | Early Times Report JAMMU, Jan 16: Chief Judicial Magistrate Preet Simran Kour rejected the bail application of Ravinder Singh Meter Reader in PDD Department who fired on advocate According to the police case that on 03.01.2025, an information has been received from reliable sources that at New Plot, Jammu one Ravinder Singh (accused herein) with intention to kill that one person namely Kanav Sharma, Advocate fired some rounds from fire arms upon him and somehow, he managed to escape. However, said person received bullet injury and got seriously injured. He has been shifted to GMC, hospital for treatment by some locals. On this information, FIR No. 01/2025 was registered at P/S Bakshi Nagar and investigation followed. CJM Jammu Preet Simran Kour after hearing Advocate Deepika Pushkar Nath for the applicant whereas APP Vikram Parihar for the UT, observed that there was an altercation between applicant/accused and victim over parking issue due to which scuffle had taken place between parties and finally applicant/accused shot fire on victim. Although, again admittedly as urged by Ld.Counsel for applicant/accused that nothing on record has come that parties were already known to each other or that they had previous enmity with each other meaning thereby that applicant/accused has no malafide intention to kill victim. However, one cannot loose sight to the act of applicant/accused who carried pistol with him and that too at day time. Although, there is no bar in keeping a licensed pistol with him, however that does not give him right to harm anyone and opens fire in broad day light over a minor issue of parking which is unbecoming of a good citizen and is a great threat to the safety of society and under such circumstances, one cannot take a plea of right of applicant as to his personal liberty and his health issues. In recent times, there are several cases of people being shot over minor issues and then plea of personal liberty is taken. The present incident has taken place in broad day light at a public place where people from all walks of life were around, and they were more chances of mishap to other persons around also. In my opinion, to curb such incidents which is threat to peace and security of general public and society at large, court has to deal with such persons with tough hands. No one is given right to play with the life of any person by using excessive force which was not required and which he was not authorized to do so. In the present case, the accused/applicant is alleged to have committed a serious offence of attempt to murder which is a heinous offence. From the perusal of the CD file, it clearly reveals that applicant/accused has prima facie committed the said offence and there are sufficient grounds to presume the involvement of accused / applicant in the alleged crime and the fact that investigation is in progress. With these observations Court rejected the bail application. —JNF |
