In a move to support the families devastated by the August 14 cloudburst at Chasoti in Kishtwar District, authorities have decided to officially declare the 32 missing persons dead within six months.
Ordinarily, the law requires a waiting period of seven long years before a missing person can be officially declared dead. This rule, rooted in the need to safeguard against error and fraud, has its place in ordinary circumstances. But disasters like the Kishtwar cloudburst demand more than adherence to procedure; they demand compassion, pragmatism, and recognition of the realities that survivors face. By choosing to relax this rule and officially declare the 32 missing persons dead within six months, the administration has taken a decision that balances legality with humanity.
No amount of financial aid can truly make up for the loss of a loved one. Lives cannot be measured in rupees, nor can grief be lessened by compensation. Yet, relief measures have a vital role to play. For many of the affected families, especially in remote and economically vulnerable areas like Chasoti, financial support may mean the difference between despair and survival. Whether it is rebuilding homes, educating children, or sustaining daily needs, this assistance becomes a lifeline in the aftermath of catastrophe.
The government’s decision also reflects a broader shift towards responsive governance. Rules are meant to serve people, not the other way around. By recognizing the extraordinary nature of the Kishtwar disaster and adapting legal processes accordingly, the administration has sent a powerful message: that empathy and pragmatism can and should coexist in public policy. This precedent can serve as guidance for handling similar cases of mass disasters in the future, ensuring that affected families are not made to endure unnecessary procedural delays on top of their suffering.
However, while the move is commendable, it must be followed by transparent and efficient implementation. Relief funds should reach the intended beneficiaries without leakages, delays, or other hurdles.
Equally important is the long-term approach—strengthening disaster preparedness, improving early warning systems, and reinforcing infrastructure in vulnerable regions like Kishtwar, where cloudbursts and flash floods are becoming increasingly frequent due to climate change.
The declaration of the missing as deceased is not just an administrative decision; it is an act of recognition—recognition of the reality that these lives were lost to forces beyond human control, and that their families deserve both dignity and timely support. Compassion in governance is measured not only in words but in decisions like these.
