Early Times Report JAMMU, Jan 19: The J&K Special Tribunal, Jammu has directed the respondents in the Royal Omkar Nest housing project to maintain status quo and not to raise or bring under construction any structure in the project's common areas as per the original sanctioned plan, in a dispute filed by Sandeep Kumar and others. In its interim order, the Tribunal noted the grievance that the clubbed/common area was allegedly being compromised by carving out two commercial vends (shops)-about 835 sq ft (approx.)-which, the appellants contended, were not part of the original plan and were being put up for sale to the detriment of allottees. Accordingly, the Tribunal ordered the respondents to maintain status quo regarding title and possession of the two commercial spaces (shops) forming part of the club area till further orders, while clarifying that for other residential units already sold as per the sanctioned plan, the respondents may execute conveyance deeds in accordance with law. The matter has been listed for February 11, 2026. The order also records that the respondents raised a jurisdiction/bench competence objection under the RERA Act, referring to a government notification designating the J&K Special Tribunal as the Appellate Tribunal for the time being, a question the Tribunal said would require deliberation at an appropriate stage. —(JNF) |
