Court refuses bail in Rajeev Nagar attack case

JAMMU, Jan 30: A Jammu court has rejected the bail plea of Golu, accused in an alleged attack at Rajeev Nagar, Narwal, observing that the case involves grave, heinous and non-bailable offences and that the investigation is still at an initial stage.
The order was passed by the Court of Sub Judge/Special Mobile Magistrate, Jammu, Slahuddin Ahmed in Bail App/60/2026 in connection with FIR No. 27/2025 of Police Station Bahu Fort underSections74/ 109 /111/ 191(2)/ 191(3)/351(2)/ 352/307/324(4)/333/61(2) BNS and 4/25 Arms Act.
As per the police report, the accused was arrested on 18.01.2026 and is in custody since then. The prosecution alleged that on the same morning around 7:30 AM, a group of 25-30 persons, including the applicant, allegedly entered the complainant's lane in Rajeev Nagar armed with weapons, broke open the house door, assaulted family members and allegedly attempted sexual assault on the complainant's daughter; the accused also allegedly displayed weapons and issued threats, including on social media, and while fleeing allegedly snatched a gold necklace besides damaging household property.
Opposing bail, the prosecution submitted that the offences were serious and that several co-accused were absconding, warning that release could lead to tampering with evidence, intimidation of victims/witnesses and hindrance to investigation.
The court noted that in offences allegedly committed by an unlawful assembly, the role of each accused is a matter of evidence and cannot be conclusively assessed at the bail stage. It further observed that since the investigation is at an initial stage and co-accused are yet to be arrested, the possibility of influencing or intimidating victims/witnesses cannot be ruled out.
Accordingly, the court held that the accused is not entitled to bail at this stage and dismissed the application, clarifying that observations are only for disposal of the bail plea and shall not affect the merits of the case. (JNF)
