Early Times Report JAMMU, Oct 6: In significant relief to contractual and daily-wage employees of the IGNOU Regional Centre Srinagar, the High Court of Jammu & Kashmir and Ladakh has allowed three connected writ petitions and directed that their cases be dealt with in accordance with an earlier Division Bench ruling on regularisation. Justice M.A. Chowdhary held that the petitioners' claims for regularisation and continuation in service were covered by the directions issued by the Division Bench in LPASW No. 91/2016. Under those directions, the IGNOU Board of Management is required to consider whether the long-serving contractual employees can be regularised and pass a reasoned decision. Until such a decision is taken, the petitioners are to continue in engagement and cannot be replaced by other daily wagers, contractual workers or personnel supplied through manpower agencies. The Regional Director, IGNOU Srinagar, is also required to place the employees' cases, including their length of service, before the Board of Management for consideration. The Court accordingly disposed of SWP No. 873/2014, SWP No. 1548/2014 and WP(C) No. 2870/2019 in terms of the earlier Division Bench directions. (JNF) |
