| President, deputy of Hiranagar MC restrained fro taking decissions | | | Early Times Report Jammu, June 25- Jammu and Kashmir High Court today restrained President and Vice President Municipal Committee Hiranagar from taking any decision and entering into any contract for and on behalf of Municipal Committee. This direction was passed in a writ petition filed by Soma Devi member Municipal Council Hiranagar against the order of J&K Special Tribunal passed on June 5, 2009. The Vacation Judge of the J&K High Court Jammu Wing Justice JP Singh restrained Rajeev Jasrotia and Bharti Sharma from taking any decision in their capacity as President and Vice President of Municipal Committee Hiranagar and to enter into any contract and for and on behalf of Municipal Committee. Justice Singh, after hearing Additional Advocate General Seema Shekhar appearing for the state, directed the petitioner to supply copy of the petition to the counsels appearing for the respondents for filing objections and ordered the petition be listed for consideration on June 29. In the petition it has been submitted that 7 out of 12 members of Municipal Committee Hiranagar moved a notice of intention on May 29, 2009 requiring the President and Vice President to vacate their offices. Before the said notice could be acted upon by the Secretary Municipal Committee Hiranagar, the President and Vice President, in order to hide their misdeeds, approached the J&K Special Tribunal Jammu and filed a revision against the said notice by concealing the facts and obtained ex-parte order, whereby the member Special Tribunal directed to maintain status-quo. Aggrieved by this order the petitioner filed this petition in the state High Court seeking quashment of the order passed by the Member J&K Special Tribunal Jammu. The counsel appearing for the petitioner Advocate Amit Gupta submitted that President and Vice President having lost confidence of the members, have no authority to act on behalf of Municipal Committee Hiranagar, but in view of the interim order passed by the J&K Special Tribunal on June 5, 2009, they are taking steps to award contracts on behalf of Municipal Committee to their favorites.
