Warrants against DDC Poonch, salary attached

Jammu, July 02- While taking serious note of non implementation of Court directions, Justice Nirmal Singh of J&K High Court Jammu Wing today ordered attachment of salary of District Development Commissioner Poonch till further orders. The Court also directed that the presence of said officer shall be secured on July 8, 2009 through bailable warrants to the tune of Rs 10,000 to be executed through SSP Poonch.
These directions were issued in a petition filed by one Ghulam Hussain in which Advocate MA Bhat appeared for the petitioner. On the previous date of hearing the High Court had directed DDC Poonch to file status report indicating the steps taken by him in implementing the judgment dated March 22, 2004 passed by the High Court, regarding payment of compensation to the petitioner. This was to be done on or before June 26, 2009, failing which the respondent was directed to remain present in person. When the matter was taken up for hearing today neither the respondent nor his representative appeared in the court and more so no status report was filed.
While issuing bailable warrants for securing the presence of the DDC Poonch, Justice Singh observed that it be seen that this is not the isolated case where it came to the notice of this Court that the orders passed by the High Court are not being implemented by the authorities to whom the directions in this regard are issued. Day in and day out, High Court comes across such like cases, there is either non implementation of the orders passed by the High Court or there is no appearance on behalf of the respondent state to assist the Court as to what action has been taken in such like matters.
The Court further observed that in the present case there was a direction to the DDC Poonch to either file status report failing which he was to appear in person. The said order was duly served upon the respondent and despite that the direction has not been complied with leaving this Court with no option but to take a view that the said respondent has deliberately and intentionally not appeared before the Court, Justice Singh observed and ordered attachment of salary of DDC Poonch and also issued bailable warrants for securing his presence in the Court.
