Court cancels bail of ‘Guru’ involved in kidnapping, rape case

Jammu, July 03- While canceling interim bail, the Court directed for taking the accused into custody and sent him to judicial lock up. The accused Narinder Pal of Rehari colony was allegedly involved in rape and kidnapping case.
After going through the statements of the prosecutrix, the Forest Magistrate Jammu Yahaya Firdou observed that while evaluating evidence court must remain alive to the effect that in case of rape no self respecting women would come forward in a Court just to make a humiliating statement against her honor. Though Court is not dealing with trial but the statement of the prosecutrix and the other evidence like medical report cannot be over sighted. Court believes that it should find no difficulty to act on the testimony of victim of sexual assault and in such circumstances why should statement of the prosecutrix be viewed with doubt and referred various judgments of the Supreme Court and High Court . The Court is of the view that while dealing with the cases of rape or molestation, where the interest of the society at large is involved, the approach of the Court should be humanitarian. Therefore, after taking into account the evidence on record, the interim bail granted vide order June 18, 2009 to the accused is cancelled and directed to take the accused in custody and sent him to judicial lock-up.
According to the case on April 7, 2009 the accused Narinder Pal alias Tulsi, who was known to prosecutrix and also Guru of her family, used to call her as his daughter, told the prosecutrix that her family is running under difficult times and the family is poor. The accused assured that he will solve all the problems of her family and on this the accused asked her to accompany him up to his residence as the prosecutrix was going to school but on the request of the Guru she went to the house of the accused. After giving some Parshad she was told to accompany him in the Matador. On eating Parshad she became unconscious and when she recovered she saw that till then they had reached Pathankote. Thereafter she was taken to Himachal Pradesh, Billaspur and where the accused hired a room and kept her in the room where the accused committed rape on her and also threatened her of dire consequences. Police had recovered the prosecutrix on May 23, 2009. JNF
