| Killer of wife gets life imprisonment | | | Early Times Report Doda, July 03- Additional Sessions Judge Doda Pawan Dev Kotwal today awarded life-imprisonment and fine of Rs 10,000 to Joginder Singh son of Shiv Lal resident of Chiralla Tehsil Thathri for committing murder of his wife in 2003. While awarding life-imprisonment to accused Joginder Singh the Additional Sessions Judge referred various judgments of the Supreme Court and High Court and held that the evidence demonstrate that the act committed by the accused pouring kerosene oil and setting the deceased ablaze was premeditated. The act committed without any provocation from the deceased’s side, sufficiently establishes the guilt of the accused. Court held the accused guilty of murder punishable u/s 302 RPC. Court after hearing both the sides observed that though offences of like nature i.e. bride burning are on rise in our society and perpetrators of such crime need to be dealt with sternly. However this case does not fall in the category of rarest of rare case and moreover the young age of the accused and his minor daughter who has already lost her mother, are the mitigating circumstances to sentence the accused to life-imprisonment rather than imposing death penalty. The accused during the intervening night of May, 26-27, 2003 had a tiff off with his wife Babli Devi and poured kerosene oil and set her ablaze. The deceased Babli Devi raised hue and cry upon which the landlord Ajit Singh and his wife came on the spot and extinguished the fire but till then Babli Devi had received 60 percent burn injuries. She was taken to District Hospital Doda from where she was referred to GMC Jammu where she succumbed to her injuries on June 6, 2003. JNF
